Attorney biography Jesse Howard Witt, principal of The Witt Law Firm, practices in the areas of appeals, construction law, entity formation, and general civil litigation. He completed his juris doctorate at the University of Denver, where he was an editor of the TRANSPORTATION LAW JOURNAL and an attorney in the Student Law Office, the oldest academic legal aid clinic in the United States. Mr Witt also holds a bachelor’s degree in astrophysics from the University of California at Berkeley and has studied in the astronomy department of the Università degli Studi di Padova near Venice, Italy. He is admitted to appear before all state courts in Colorado and California*, in the United States District Courts for the Districts of Colorado and Northern California*, and in the United States Court of Appeals for the Tenth Circuit. Mr Witt served as a law clerk to the Hon. Frank Martinez in Denver, and he worked in private practice for many years with the firms of Burdman & Benson and Benson & Associates. Before and during law school, Mr Witt supervised excavation crews as a union grade setter on various residential and commercial developments. In his law practice, Mr Witt believes that a collaborative approach involving both attorney and client is crucial to success. He represents his clients aggressively and professionally, and he is a strong proponent of alternative dispute resolution. Mr Witt is a member of the American, Colorado, and Denver Bar Associations, and of the ABA Forum on the Construction Industry. He also serves on the amicus curiae committee of the Colorado Trial Lawyers Association and the legislative action committee for the Community Associations Institute. He has testified in Colorado State Assembly in support of homeowner legislation and has given presentations on Colorado construction law, electronic document management for law firms, and other topics. He is one of just seven attorneys in the United States to be a member of the Associazione Internazionale Giuristi di Lingua Italiana, the International Association of Italian Language Lawyers. Mr Witt is a frequent author, and his article The Spearin Doctrine and the Economic Loss Rule in Residential Construction was selected in 2007 for inclusion in the LEGAL HANDBOOK FOR ARCHITECTS, ENGINEERS, AND CONTRACTORS. Mr Witt grew up in Crockett, California, a small suburb of San Francisco known as the home of the world's largest sugar cane refinery and—more recently—of the pop-punk band Green Day. Mr Witt now lives in Colorado with his wife and children and enjoys sailing his restored 1956 Lightning sloop, Zephyr, in his spare time. * Currently inactive. |

Appeals Successful resolution of an appeal demands specialized skills. Appeals are decided almost entirely on the parties' written briefs, which must be carefully drafted to identify the strongest issues and to present a party's arguments in a concise and convincing matter. An appellate lawyer often needs to argue not only the merits of his or her client's case, but also explain why a given rule should be adopted as precedent for future cases. If reversal is sought, the appellate lawyer must overcome both the arguments of opposing counsel as well as the echoes of the lower court's reasoning.
